Kenneth M. Tschetter

Ken is a South Dakota native who was raised in Rapid City and moved to Sioux Falls in 1999. Ken earned an undergraduate degree in Business Administration from the University of Kansas, and subsequently graduated from law school at KU in 1994. During law school he was selected for the Law Review, won multiple American Jurisprudence academic Awards, and finished in the top ten percent of his class, earning membership in the prestigious Order of the Coif.

Kenneth M. Tschetter

 After law school, Ken obtained valuable experience as a research attorney for the Kansas Court of Appeals, and was selected to serve as the research attorney for the Chief Justice of the Court of Appeals.  In 1999 Ken returned to South Dakota, and began practicing criminal defense at the Minnehaha County Public Defender's Office. He soon entered private practice, and in 2003 opened his own law office focused on criminal defense and family law. Now, after thirty-two years working as an attorney, Ken has significant experience handling many types of legal matters. The law office he started has grown to a much larger team of lawyers and assistants who stand ready to help their clients with all manner of legal issues. 

Today, Ken’s practice remains primarily family law. He has represented clients in hundreds of divorce, child custody, child support, relocation, and guardianship matters. He also handles many cases involving gestational surrogacy through Assisted Reproductive Technology (ARTs). He has vast experience in gestational surrogacy matters, including drafting and negotiating surrogacy contracts, preparing parentage pleadings and documents, and helping both surrogates and intended parents from all over the world establish legal parentage for children born through surrogacy. Ken is a longstanding member of the ARTs Committee of the Family Law Section of the American Bar Association, and has served as Of Counsel for two national ARTs groups.

 Ken is licensed to practice in state and federal courts in South Dakota, and also holds licenses in both Kansas and Utah. He is a member of the South Dakota Trial Lawyers Association, the Second Circuit Bar Association, the American Bar Association, and the South Dakota Association of Criminal Defense Lawyers. Ken has served on the Family Law Committee for the State Bar of South Dakota, and on the Supreme Court’s Committee regarding Interpreters and Translators in the South Dakota Court System.


Ken and his wife are the proud parents of four daughters.


Jason R. Adams

Jason is a native of Janesville, Minnesota. He grew up on a small farm outside of Janesville. He graduated from Southwest Minnesota State University in Marshall, Minnesota, with a degree in political science and a minor in business administration in 1994. Jason attended law school in Vermillion, South Dakota, and graduated from the University of South Dakota School of Law in 1997.

Jason R. Adams

Following law school, Jason practiced law in Elk Point, South Dakota at Stickney & Groe Law Office. After three years in Elk Point he joined the Minnehaha County Public Defender’s Office and was there for seven years before joining Ken Tschetter to form Tschetter & Adams Law Office, P.C. While at the Public Defender’s Office, Jason gained valuable experience defending cases from DUI’s to Murder, and a Capital Murder Case. 

Recently, Jason has represented multiple individuals charged with murder, rape, aggravated assault and other major felonies. He also represents individuals that have family law issues or personal injury matters. 

Jason has over 25 years of experience handling criminal cases, family law cases and personal injury cases. His experience includes numerous jury trials and appellate work. In 2023, Jason received the “Outstanding Lawyer Award” from the South Dakota Criminal Defense Lawyers, which is awarded annually to one attorney that ensures justice and due process for his clients.

Jason is licensed to practice in state and federal court in South Dakota. He is a member of the National Association of Criminal Defense Lawyers, the South Dakota Criminal Defense Lawyers and the Second Circuit Bar Association. Jason serves on the South Dakota State Bar’s Criminal Pattern Jury Instructions Committee.

Jason and his wife Kami have two sons and a daughter. He spends his free time golfing, camping and boating.


Matt Theophilus

Matt is a South Dakota native who grew up in Sioux Falls, graduating from Lincoln High School in 1987. He then attended Gustavus Adolphus College in St. Peter, Minnesota, for two years of undergraduate study before transferring to and graduating from the University of South Dakota in 1992 with a Bachelor of Arts degree in Political Science and Criminal Justice. He completed law school at the University of Wisconsin—Madison, attaining his Juris Doctor degree in 1996, with a primary focus on criminal law.

Matt Theophilus

After graduating from law school, Matt served as a deputy state's attorney at the Minnehaha County State’s Attorney’s Office for 7 years. While there, he was named a Senior Supervising Deputy State’s Attorney, overseeing a newly created Domestic Violence Unit and revamping the investigation and prosecution of domestic violence crimes. Matt also drafted legislation, including several statutes that became law in South Dakota. Based upon this experience, Matt was appointed as a state- and nationwide training attorney for the Federal Law Enforcement Training Center, the National Sheriff’s Agency, the National Center for Preventing Abuse in Later Life, the South Dakota Network Against Domestic Violence and Sexual Assault, and the South Dakota Law Enforcement Training Academy in Pierre, South Dakota. During his tenure, Matt trained law enforcement, victim advocates, judges, probation officers, and other justice system personnel across the county on a wide range of issues involving domestic violence, elder abuse, and sexual assault. After leaving the State’s Attorney’s Office, Matt served as the executive director of the Rape & Domestic Abuse Center for two years prior to entering private practice. Matt joined Tschetter & Adams as an associate attorney in 2020.

Matt specializes in criminal defense. Licensed in state and federal court in South Dakota, his criminal law practice includes defending both misdemeanor and felony cases in adult and juvenile court. He also handles a wide range of court appointments. Matt has extensive jury trial experience, including over 80 jury trials in state and federal court. He practices primarily in eastern South Dakota, including Minnehaha and Lincoln Counties. Matt is a member of the South Bar Association, the Second Circuit Bar Association, and the South Dakota Association of Criminal Defense Lawyers. 


Jamie L. Weber

Jamie is a South Dakota native who graduated magna cum laude with Bachelor of Science Majors in Criminal Justice and Political Science in 2005. She then went to the University of Iowa where she graduated from law school with distinction in 2008. She completed her joint degree and graduated with her Masters of Health Administration in May 2009. 

While at the University of Iowa, Jamie honed her research and writing skills through participation as a student writer for the Iowa Law Review. She was honored to have the editorial board select her note for publication. She was selected for a moot court competition based on her written and oral arguments. 

Jamie Weber

After law school, Jamie returned to South Dakota and joined Cathy Piersol and Jim Billion in 2009. She began personally working cases and accruing experience in court right out of the gate. Within her first year of practice, she served as second chair on a complex week-long divorce trial. 

While at the University of Iowa, Jamie honed her research and writing skills through participation as a student writer for the Iowa Law Review. She was honored to have the editorial board select her note for publication. She was selected for a moot court competition based on her written and oral arguments. 

Since then, Jamie has gained 17 years of experience as an attorney. Her practice focuses primarily on family law including divorce, separation, child custody, parenting time, visitation, child support, adoption, and appeals. She also has extensive experience in abuse and neglect cases and has worked in criminal defense and personal injury. Jamie is licensed to practice in state and federal courts in South Dakota. 

Jamie and her husband, Derrick, are proud parents of two wonderful children and a Vizsla.
